Thank you for using Spiritualize ("we", "us", "our", “Service”). If you have any questions and/or any concerns regarding this privacy policy, or any questions regarding the use of your personal information by us, please contact us at spiritualize.app@gmail.com 

This privacy policy applies to all information collected through our services (the “Services”, which includes our mobile application (the “App”), as well as through any related services, sales, marketing, newsletters, or events). 

We hope you take some time to read through this document carefully. If there are any terms in this document that you do not agree with, please discontinue the use of our Services.

1. User Consent

By downloading or using our App, you agree to the terms of this Privacy Policy and you expressly consent to the collection, use and disclosure of your Anonymous and Personal Information, as defined in the section Types of Information that We Collect, in accordance with this Privacy Policy.

For users in the European Economic Area (the “EEA”), we comply with the guidelines of GDPR, including requiring consent before collecting and sharing Anonymous and Personal Data with third party advertisers.


2. Types of Information that We Collect

(a) Information You Provide to Us

• We collect your personal information such as your Name and Email Address, for the purpose of Signing up, personalization of our Services, and contacting you via Email, if required.

• If you provide us any feedback or contact us (for support, for example), we will collect Personal Data including your name (and e-mail address or other address you provide), as well as any other content included in the communication. We use this information to assist you with your inquiry or support requests, and to send you Spiritualize related communications. 

(b) Information via Technology (Anonymous) 

• Our servers (which may be hosted by a third party service provider) collect information from you, including your browser type, operating system, application software, Internet Protocol (IP) address (a number that is automatically assigned to your computer when you use the Internet, which may vary from session to session), domain name, date/time stamps for your visits to our website or use of the App, your DID, your location, your device type.

 • We may also use cookies and URL information to gather information regarding the date and time of your visit to the Site and the information for which you searched and which you viewed. “Cookies” are small pieces of information that a website sends to your computer’s hard drive while you are viewing a web site. We may use both session Cookies (which expire once you close your web browser) and persistent Cookies (which stay on your computer until you delete them) to provide you with a more personal and interactive experience on our Site. Persistent Cookies can be removed by following Internet browser help file directions. If you choose to disable Cookies, some areas or features of our Site may not work properly.

3. Use of Your Information

Personal Data

In general, we use any personal information collected through our App or website for a number of business purposes as elaborated below:

For sign-up, account creation and the log-in process. In future, if you decide to link your account with us to a third-party account (such as an Apple, Google, or a Facebook account), we may use that information to assist you with the sign-up, account creation and log-in process.

Manage your account: We may use your information for managing your account properly and keeping it functional, and other administrative purposes such as changes in product or terms, conditions, and policies. We may also need to share your data in the event of a legal request or subpoena that we may receive. 

Suggestions and Feedback. We may use your information to reach out and request feedback and suggestions that can help us improve our App.

Customer Service: We may use your personal information to respond to any user inquiries or any potential issues related to the use of our Service.

Marketing communications: We and/or our third-party marketing partners may use your personal information to send you marketing communications such as newsletters, emails, if this is in accordance with your marketing preferences. You can opt-out of our marketing emails at any time by de-selecting the option during sign-up or writing to us at spiritualize.app@gmail.com 

Testimonials. We post testimonials on our App that may contain your personal information. Before posting any testimonial, we will obtain your written consent for doing so. If you so decide to delete, or update such testimonial, please write to us at spiritualize.app@gmail.com , citing your name, and the exact testimonial that you wish to update or delete the testimonial.

For other business purposes. We may use your information for other business purposes, such as data analysis, identifying usage trends, targeted advertising, etc., and to evaluate and improve our App, and the overall user experience.

 

4. Sharing Your Information

We may share your personal information that we hold for the following purposes:

(a) Third Party Service Providers

We may share your DID, Personal Information, and/or usage data with third party service providers, contractors or agents who perform services for us or on our behalf and require access to such information to do that work. These third-party service are used for the following reasons:

  • To facilitate our Service;

  • To provide the Service on our behalf;

  • To perform Service-related services; or

  • To assist us in analyzing how our Service is used.

However, they are obligated not to disclose or use the information for any other purpose.

(b) Analytics and Advertising

We may share your personal information with companies that perform analysis of data regarding our website or our Apps (or allow them to collect your DID, Anonymous Data and IP addresses): to analyze the use of the Site or the Apps for us.

We may use third-party advertising companies to serve ads when you visit or use the App. These companies may use and track information about your visits to our website and our App, and may use web cookies and other tracking technologies in order to provide advertisements about goods and services of relevance to you.

(c) Acquisitions

If another company acquires our app, business, or our assets, that company will possess the Personal Information and Anonymous Data collected by us and will assume the rights and obligations regarding your Personal Information and Anonymous Data, as described in this Privacy Policy.

5. Third Party Websites and Applications

When you click on a link to any other website or location, you will leave our website or App and go to another site and/or app and another entity may then collect Personal Data or Anonymous Data from you. We have no control over, do not review, and cannot be responsible for, these outside websites, applications or their content. Please be aware that the terms of this Privacy Policy do not apply to these outside websites or content, or to any collection of data after you click on links to such outside websites, or applications.

6. Your Choices Regarding your Data

(a) Do Not Sell My Info

If you are using our App, you may opt out of the sale of what is deemed your personal information (what we refer to as Anonymous Data), namely device advertising ids, that allow advertisers to target advertising to you based on interests.

Your iOS or Android mobile device provides a “Limit Ad Tracking” or “Opt out of interest-based advertising” setting. When you have used this setting on a device, our advertising partners, will not use information collected from that device to infer your interests or serve ads to that device that are targeted based on your inferred interests.

You can find the setting for your mobile device by following the directions below.

iOS Device:
Your iOS device may provide a "Limit Ad Tracking" setting. Enabling the Limit Ad Tracking feature does not block Ads from collecting data from your device activities, but it limits the ability of companies to send you targeted and interest based Ads.

1. Open the "Settings" app.
2. Tap "Privacy".
3. Scroll down to the bottom of the page and tap "Advertising".
4. Toggle the "Limit Ad Tracking" switch on.

Android Device:
Your Android device settings may allow you to "Opt out of Interest-Based Ads."

On Android 6.0 or higher:

1. Open "Settings"
2. Look for "Google Services & Preferences" and tap on it
3. Tap on "Ads"
4. Toggle the "Opt out of Ads Personalization" switch on.

Android 5.1 or lower:

1. Open "Settings"
2. Tap "Accounts"
3. Tap "Google"
4. Tap "Manage your Google Account" (This will open up a new page with your Account information)
5. Tap "Data & Personalization"
6. Scroll down to "Ad Personalization"
7. Tap "Go to ad settings"
8. Toggle "Ad Personalization" switch to OFF

When you opt out, you may still see the same number of ads from our advertising partners on your mobile device; however, these ads may be less relevant because they won’t be based on your interests. Our advertising partners may continue to serve you ads based on other non-personal information, such as ads related to the content of the application you are using.

(b) Changes to Your Data
You may request deletion of your Anonymous or Personal Information by us, but please note that we may be required to keep this information and not delete it (or to keep this information for a certain time, in which case we will comply with your deletion request only after we have fulfilled such requirements). When we delete any information, it will be deleted from the active database, but may remain in our archives.

7. Retention

We will keep your information for as long as your account is active or we consider necessary for the purposes described in this Privacy Policy. We will also retain and use your information for as long as is required in order to comply with our legal obligations.

8. Security of Your Data

We are committed to protecting the security of your Anonymous and Personal Information. We have implemented appropriate technical and organizational security measures designed to protect the security of any personal information we process. However, despite our safeguards and efforts to secure your information, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee its absolute security. Transmission of personal information to and from our App is at your own risk and we advice you to only access the App within a secure environment.


9. Your California Privacy Rights:

If you are a California resident, you have the right to request information from us regarding the manner in which we share certain categories of your Personal Information with third parties for their own direct marketing uses. California’s “Shine the Light” Act provides that you have the right to submit a request to us at our email address in order to receive information on the categories of customer information that we shared and the names and addresses of those businesses with which we shared customer information for the immediately prior calendar year. To obtain this information, please send an email message to spiritualize.app@gmail.com with "Request for California Privacy Information" in the subject line and in the body of your message. We will provide the requested information to you in your email address in response.

Please be aware that not all information sharing is covered by the Shine the Light requirements, and only information on covered sharing will be included in our response.

10. International Transfer

These Services are hosted in Canada and subject to applicable Canadian Federal and Ontario provincial laws and regulations. Your personal data may be transferred to, stored at and processed by us and our affiliates and other third parties outside the country in which you reside, including, but not limited to Canada, where data protection and privacy regulations may not offer the same level of protection as in your country. By using our Services, you consent and agree to this transfer, storing, processing and use of your personal data in accordance with this Privacy Policy.

11. Children's Privacy

We do not intentionally gather Personal Data from users who are under the age of 13 (in the United States) or under the age of 16 (in the EEA), or under any age of a child as defined in a local jurisdiction. We also do not knowingly collect or solicit personal information from, or target interest based advertising to anyone under these respective ages, or knowingly allow such persons to use our Services, except as permitted by law.

In the case we discover that a child under 13 (in the United States) or under the age of 16 (in the EEA)  has provided us with personal information, we will immediately delete this from our servers. If you are a parent or guardian and you are aware that your child has provided us with personal information, please contact us in writing so that we can take necessary actions for the removal of such user’s personal information from our servers.

12. Openness and Your Refusal or Withdrawal of Consent

You have the right to refuse or withdraw consent to collection of personal information, and can also request access, updation, or deletion of your data, by submitting a verifiable request to us by: emailing spiritualize.app@gmail.com

You may also make a verifiable consumer request on behalf of your minor child under 13 by emailing us at  spiritualize.app@gmail.com

The verifiable request must: (i) provide sufficient information that allows us to reasonably verify yourself about whom we collected personal information or their authorized representative; and (ii) describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

13. Changes to this Privacy Policy

We may update this Privacy Policy periodically. Changes are effective immediately upon posting. The date last revised appears at the bottom of this Policy.

Continued use of our Services or Apps, following such changes to this Privacy Policy, shall indicate your acknowledgement of such changes and agreement to be bound by the terms and conditions of such changes.
